Organisations & people management Essay Example | Topics and Well Written Essays - 3000 words

Organisations & people management - Essay Example It can be seen that leadership is an indispensable component in the day to day operations of an organisation and plays a vital role in guiding the organisations through the turbulent periods. One of the major issues brought about by change is resistance to change which is a natural phenomenon but if it is ignored, it can derail progress in the organisation which is why leadership is of paramount importance to any organisation that is serious about its growth and development. In most cases, the way in which organisations respond to new challenges they face in their operations is a true reflection of the values, attitudes as well as the styles of the leaders. It is therefore imperative that leaders embrace attitudes and behaviour that are compatible with the situation obtaining on the ground at that particular moment in order to keep pace with the changes that may be taking place in the environment. It can also be seen that leadership is not an exclusive domain of the chief executive officer or the charismatic leader but in one way or the other, each one of us can find himself in a leadership position. It is also concerned with people management and factors that shape behaviour in an organisation. Though leadership is often confused with management, a holistic approach is ought to be taken as far as managing change in the organisations is concerned. Failure to put in place measures that are meant to ensure that the organisation positively responds to the changes taking place in the environment may result in unfavourable conditions to the organisation emerging. Against this background, this essay seeks to critically identify and evaluate the major influences on leadership styles and approach on the operations of Google. The essay will begin by giving a very brief description of the organisation in question which will be followed by explaining different key concepts such as leadership, leadership styles as well as management and the extent to which these

Behavioural difficulties with childern (in classroom) Essay

Behavioural difficulties with childern (in classroom) - Essay Example It seems clear that good behavior is easy to maintain if the school and other teachers in the school establish a consistent approach to misbehavior (McCormack 2006). I agree with the statement completely and have found that if teachers get together to establish certain ground rules, the overall discipline level of the entire school can be raised significantly. In my own experience I have tried to ensure that the discipline maintained in the class is equal to the level maintained by other top teachers. Of course in certain cases discipline issues can means a lot more than simple misbehavior of willfulness. McCarthy (2006) suggests that certain discipline problems could come about if the child appears to be emotionally disturbed. While this may certainly be the case, in my experience I have not come across a situation which demands the use of a facility like the Multi Agency Center mentioned in the article. However, it is good to know that such facilities exist and I certainly plan to make use of these if the need arises. I did face a situation where it came to my mind that a child was facing some emotional problems but when I talked to the child in a one on one session, we were able to come to an agreement whereby she promised to improve her behavior and I saw a marked change in her since that. The use of technology has also been recommended to keep children occupied and reduce discipline issues (Pendleton 2006). However, in my opinion this takes the focus away from the real issue. While technology is useful, I find that simply talking to the children about discipline issues and explaining how the collective experience for them is reduced in quality through the misbehavior of some children is more effective. This technique is also recommended for the improvement in the outlook of the entire school (Phillips, 2006). Finally, in certain extreme situations, a teacher may be forced to use restrictive physical means to intervene with pupils

Hoods by Angelia Betzien | Analysis

Hoods by Angelia Betzien | Analysis Hoods is an Epic theatre play, written by Angelia Betzien, directed by Leticia Caceres and composed by Pete Goodwin which is about domestic abuse. The plot is about three children, Kyle, Jessie and baby Troy, left behind in the car by their mother, who desperately had to leave everything after the abuse she had from her husband. The current issue of domestic violence is expertly dealt with in the Epic theatre style play Hoods, This will be demonstrated throughout an analysis of narration, direct address to the audience, episodic structure, fragmentary costumes and props, multiple roles, use of costume and lighting and soundtrack. Narration, a convention of Epic theatre, is used in Hoods thereby making it a strong example of political theatre. This technique is often used by actors to describe the scene to the audience to tell them what is happening. This is used as a Alienation, or called by Bertolt Brecht as the Distancing Effect , to encourage the audience to retain their critical detachment and have them thinking about the issue, which in the Hoods is domestic violence. In the play this is seen when the father kills the cat with a plastic bag, Jesse asks for a hug from a teacher, and at the end when they tell the of the story. The two actors projected their voice in sync and acted on stage while narrating. This has made a strong distancing effect to the audience as it addressed the audience of the play without actually having them being involved in the play emotionally. Narration was used throughout the play to express a much more powerful message to the audience by having the audience remained focused on what was happening rather than feeling it. Direct address is a commonly used technique used in Epic theatre for the actor to have a direct address to the audience to prepare the audience for a scene change. Brecht has employed direct address to the audience too express the message more clearly . Betzien made the play to have scene changes as often as possible to distance the audience emotionally from the play from the sensitive subject of domestic abuse. This effect has got the audience thinking and reflect on what is happening. The actors personally address the audience what the scene is, quite often speaking in sync. They explained their ability to pause, rewind and fast forward the story. With that throughout the play, they intentionally swap scenes in a blink of an eye to get the audience to focus on the new thing that is happening. The two actors always gave a direct address to the audience to have them focus. Direct address was sufficiently used throughout the play to reflect Epic Theatre and has expressed a much more p owerful message to the audience. Brecht used episodic structure in his plays because it distanced the audience from being emotional involved with the play. He wanted his views to be seen, heard but not felt as people would not think about the message if it if the audience were emotionally drawn in. Epic theatre has since incorporated episodic structure into the style to distance the audience from being emotionally attached. In Hoods it is used to explain the story of the childrens life, the abused life they have lived and the desperation of Jesse to find affection and safety. Caceres has made the actors to have scene changes to shift the audiences attention from the emotion and have them focusing on the new scene. Most occasions the new scene change was to show the progress prior to where the children got in the car, the abuse the mother coped from the father. This gives the audience the message of the play that it is about domestic abuse Episodic Structure was sufficiently used throughout the play to reflect Epic T heatre and has expressed a much more powerful message to the audience. Throughout the play the two actors change costumes and change props whenever a new scene takes place. This is done to done to get the audience to focus on the new character and scene to follow the story. It also invoked humour in the scenes that which distanced the audience to being detached from feeling the play but listen instead. During, before or after a direct address, narration and scene change, the actors change their costumes by taking off their hood, put on a hat or hold a prop. An example of a prop used in the play is the fairy wand Jesse held. Another example is Kyles hat, whenever the actor wore it, they instantly know it is Kyle. This has an effect on the play because it makes it easier to follow because the costumes identify the character distinctively. The effect of clear character by the use of voice and only one costume/prop makes the play more stronger. This is done so the audience will focus and listen to find out who the character is. This distances the audience f rom an emotional connection with the actors so they focus on the play. The soundtrack and lighting worked together hand in hand when the action on stage tensed up. An example is the end scene when Jesse got Kyle to leave the car with her to call for help. This worked really well due to the tension building music which got the audience to listen more and involved in the issue on stage. This has made an amazing effect on the play due to the after effects of the play made the audience reflect the story and issue afterwards. This was done to build the tension on stage and provoke the audience to pay attention. The lighting with the soundtrack created an atmosphere to which grew the tension. An example is when one actor was telling the story of the cat, the lighting was dark and the music was dark ambience. This created the tension that focused the audience on the story and was made because it distanced the audience from being emotionally attached. The current issue of domestic violence is expertly dealt with in the Epic theatre style play Hoods by the use of dramatic languages: narration, direct address, episodic structure, fragmentary props and costumes and soundtrack and lightening that has given the play the strong message to the audience without them emotionally attached to it.

Indian Nationalism :: Asian Asian History

Indian Nationalism Factors Promoting Nationalism Racial arrogance - on the part of the British created resentment by Indians. They were treated as second-class citizens and were given only the poorest jobs. British in positions of power, such as General Mayo (Viceroy of India) openly made statements of racial superiority. Educated Indian professionals - felt they were denied equal opportunities within the "machinery" of British rule (such as the Indian Civil Service). They founded a nationalist movement that initially sought equal status for Indians and eventually sought full Indian independence. Anti-Westernisation - Britain had changed India's traditional institutions with apparently little respect for the existing culture and religion. British modernisation - probably helped spread the nationalist message. They had improved transport and communications. Indian Association 1885 - Began as a powerless "talking shop" but turned into the Indian National Congress, where Indians could voice their complaints against the British. Educated politicians used this parliament to rally support for the movement. Lord Curzon (Viceroy 1898-1905) gave no concessions to the natives. He allowed them no representation and saw them as inferior. Division of Bengal 1906 - was unpopular because it divided the regional cultures. In India, many people had greater affinity to their region than to the whole country. Splitting Bengal led to a swell of nationalist support. Factors Restraining Nationalism India was divided regionally - There was great cultural and religious divide across the regions. There were 200 different languages spoken across India so communication on a large scale was difficult. There were also many religions (including Sikhs, Muslims, and Hindus) who would not co-operate with each other. Indian Congress was divided - Liberal wing led by Gokhale, and extremist wing led by Tilak.

How does Sylvia Fair create the character of Rosie in her short story, The Road Home? Essay

The Road Home by Sylvia Fair tells the story of Rosie a woman with an unnamed mental disability. The short story is about Rosie, tired of the abuse she has suffered at the hands of some delinquents, who taunt her almost every day. She decides to go to the police. The police tell her that the only way to deal with these boys is to charge them; sadly Rosie misunderstands thinking the â€Å"kind policeman† meant for her to literally charge the delinquents and desperate to please she does exactly that. Of course when she does this the policeman is not pleased and does not praise her; he is of course angry at her. The story gives a deep insight into Rosie’s mind and through her see the world in whole new light. As in reality it is almost impossible for us to understand what it would be like to live everyday life looking through eyes that see the world in completely different way. This is what is so attractive about Sylvia Fair’s short story; it gives us an insight tha t under normal circumstances we would never be able to receive. The Road Home opens with the words â€Å"A solid bulge appeared on the skyline of Penwan†¦Ã¢â‚¬ it is very rare in literature for a human being to be described as a â€Å"bulge†, but this opening description portrays Rosie as lacking humanity and the ability to convey complex emotions. However, this is not the case; as the story progresses the reader finds out that Rosie is like a child, she cannot understand complex emotions and her own emotions are simple. The author expresses this by employing short simple sentences conveying Rosie’s feelings such as â€Å"She felt clumsy.† Rosie’s interpretation of things is childlike. She seems to have picked up the lessons from her childhood and misinterpreted them. Things such as upon breaking her glasses the reader is told â€Å"no matter how much she washed them they still remained broken†. Another example is when a car passes her response is â€Å"to watch, to listen, to smell and to think† which brings to mind â€Å"Stop, Look, Cross.† She always takes things people say literally. This is a cause of a great deal of frustration for Rosie. She desperately tries to do what is asked of her, for example her experiences in school â€Å"Little Rosie squeezed the pencil between her fingers and pressed as hard as she could, so hard that the point broke and the paper tore. And still the teacher nagged her to try harder.† I find this extract incredibly poignant. That sentence alone conveys Rosie’s sufferings, her desperation to please those around her and her frustration when she fails to do this. Rosie is very loyal to her Beret and her Wellington as a child is loyal to a treasured teddy bear. She almost relies on them â€Å"she held her beret down to keep the thoughts in† and â€Å"her wellingtons wouldn’t let her leave.† I think the best way to explain this is that Rosie can not see her brain and the beret is the only thing that seems to make sense to her. In the story, as Rosie’s confidence grows she starts to rely on the wellingtons less and less and when towards the end of the story when she loses that confidence she quickly reverts to relying on her wellingtons again. In my mind it almost as if her beret and wellingtons have some kind of parental charm to her, it as almost as if in the absence of her parents she turns to the wellingtons and the beret for protection and care. Rosie is unable to multitask. This is shown when she is conversing with the police. She gets very upset because she is unable to keep up with everyone shouting at her from so many angles that she can’t cope with it and blocks it all out. It is only when she is spoken to kindly and gently that she is able to calm herself and take in the information. Fair does not give much description of Rosie’s appearance at all. We know she’s big, as she is described as being a mountain and a great bulk among other things. Though reading the story the reader gets an impression of her taking pride in her appearance. She takes great care of her wellingtons and her beret, although she has tied the belt rather than buckling it again suggesting her inability to perform tasks most adults take for granted. even though it is suggested she lives in a fairly deserted way I think this is not because she does not like company, but maybe because she does not have the confidence and that she finds it easier to converse with only animals and her beret and wellingtons. At the end of the short story the Road having gained an impression of Rosie’s character and her day to day struggles, it hard not to feel certain empathy towards Rosie. Sylvia Fair affectively describes her desperation for companionship and how the community that she lives in rejects because of her disabilities. Rosie’s story is tragic in the fact that because of her disability she is unable to convey her feelings to those surrounding and therefore must live her life in isolation.

Internet Encyclopedia of Philosophy

War, by its very nature, is an act that is a display of horror, violence, terror, suffering and most of all death (William Einwechter, 2004). But the question is, can the engagement of a nation in a war be considered just? What exactly is a just war? By definition, a just war is a conflict that is engaged by two nations with a fixed set of rules for combat (Internet Encyclopedia of Philosophy, 2006). But this exception applies if the two combatants possess similar traits (Philiosophy, 2006). In the Christian perspective, war, or the engagement in it, is bound by certain qualifications to make the war devoid of sin (Einwechter, 2004).God Himself has depicted Himself as a warrior, waging wars on the unrighteous (Einwechter, 2004). It would be understood that if warfare is inherently evil, then warfare would not be a correct and accurate depiction of God's character (Einwechter, 2004). And second, God directly ordered his people to engage in war, to annihilate threats to their country a nd people (Einwechter, 2004). But to better get a grasp of war, we must include in the two views that are inherent in the decision to see if a war is right or wrong. The pacifist belief holds that all war or the engagement in war is inherently wrong, while the realist belief states that in war, all is fair and right (John Buell, 2002). But the concept of engaging in war cannot be deduced to the superiority of one party over the other in terms of military might (Paul Ramsey, 2002). To Christians, what is made as the case for declaring a war unjust is when the commandment against killing is viewed in a legalistic manner, precluding all other interpretations (Ramsey, 2002).The war on terrorism cannot be viewed therefore as a just and correct conflict (Dale Snauwaert, 2002). Terrorism is not an identifiable enemy, just as what God commanded in the ordering of wars against certain and specific people (Einwechter, 2004). As President Bush's statement attests, the war is on terrorism, not o n a single threat of a nation or alliance (Snauwaert, 2002). The President's â€Å"war† is not with a terrorist nation, but an ideology, a strategy (Snauwaert, 2002). Secondly, in the Bush war, the threat is not imminent (Snauwaert, 2002).It is what the government calls â€Å"pre-emptive action†, an attack against a perceived, not an actual, threat (Snauwaert, 2002). The mandate for the use of violence, such as in engaging in war, is the prevention of violence, not the spread of it (David Nils Gyllenhaal). Citing from law enforcement, if a criminal will do more harm if he is not killed, then the actions in war is to stop the incidence of a nation's actions in spreading its violence, and that will take force to accomplish (Gyllenhaal).ReferencesBuell, J. my brother my executioner essays

my brother my executioner essays MY BROTHER, MY EXECUTIONER Conscience brings not only illumination but also agony: It relentlessly exposes the inner battle that human being must wage war against their own impulses. This was said by Paul in Romans 7 : 15 20. This inner battle within ourselves started since the beginning of time and still continues today and will do so in the future. It is the greatest battle that we will fight. A seemingly endless confrontation that we will have to endure as long as we still steps our foot in the ground, as long as the need for oxygen remains, as long as the blood runs through our veins. Conscience that will always be there, always mind-bogging you. Conscience that will always be there, always telling what you ought to do. Conscience that will be there to guide you in everything that you do. Conscience that will always be there, continuously shaping yourself to what you can really be. The novel, My Brother My Executioner, tackles a lot of conflicts. Conflicts that ranges from deep within up to the environment and surroundings. Conflicts which will always be there, continuing to shape us to what we are now and to what we can be in the future. Conflicts that will teach us a lot of things in life. Conflicts that will open our eyes to what is really happening around us. My Brother My Executioner circles around two major characters. These two main characters are brothers in the story. Their names are Luis and Victor. Brothers with two different views in life. Two brothers with different outlook in things. Two brothers with different life style in which they are living in. Two brothers living in the both end of the world. Two brothers born in the same womb but with different fathers. Aside from these characters, Don Vicente, Trining, Ester and Dantes, are also present. These characters are the next important ones. Each one adds a twist in the story. Each character possesses a unique personal...

A Virtual Battlefield

Cyber warfare is an oncoming threat that will result in devastation. Cyber weapons can seriously hurt a country, and cause chaos that will match Pearl Harbor. Picture this- the click of a mouse could disable air traffic control screens, explode fuel refineries, steal valuable information, derail trains, and fry power grids. All capabilities of a cyberattack. And the bad news is the United States is not as prepared as it should be (for this new kind of warfare), and it’s happening right now. I can’t believe that the United States’ cybersecurity isn’t faring that well. We have known of the threat for a long time, yet defensive measures haven’t been taken. We seriously need to end this threat-our whole nation is at risk. Of course, CYBERCOM is a good start, but there really should be more members, which would result in a larger task force, and a stronger cyber defense. Not all cyberweapons are on a nation crippling scale, however. There have been some attacks on Google and Western Energy Companies, and investigators believe China was the aggressor, and Google declared Cyber War on China. Don’t believe that Google, of all companies, got cyberattacked? Check out http://gpsanalysis.com/?p=41 But, of course, some nation-scale warfare has happened, to the United States, too! In April of 2009, cyber spies infiltrated the Pentagon’s Joint Strike Fighter Project, an approximate three-billion dollar project, and were able to escape with huge amounts of data that was related to the aircraft’s design. Again, officials point to China. Ok†¦maybe Google, but the Pentagon got cyberattacked? Check again! http://www.popsci.com/military-aviation-amp-space/article/2009-04/hackers-breach-joint-strike-fighter-program Although China seems to be the most active offensive cyber attacker, America isn’t just a passive victim. In 2010 Israel and the United States hatched the Stuxnet virus, which targeted Iran’s nuclear enrichment facilities and basically destroyed thousands of centrifuges that were used to purify Uranium. Another cyberweapon hatched by the United States was the Flame virus. This virus seeped through the computers of Iran’s high-ranking officials, and collect information. http://topics.nytimes.com/top/reference/timestopics/subjects/c/computer_malware/stuxnet/index.html Iran has been receiving some heat from the United States and Israel ever since they began their nuclear weapons program. Yet Iran has been on the offensive side too. A cyberattack shut down RasGas, a producer of liquid natural gas in Qatar, and destroyed valuable computer data at Saudi Aramco- the world’s most valuable company. US intelligence confirmed that the aggressor was Iran. Many more cyberattacks have happened around the world though. I’m not going to sit here typing every single cyberattack. Hopefully you get my main point- Cyber warfare is happening RIGHT NOW. Although cyber warfare can really only frustrate and confuse temporarily, a nation can not win a war if the other side has it. That is why not only offensive measures, but defensive measures, are important. Blocking a cyberweapon from destroying data could cost you the outcome of a war, and bring victory to your side. But cyber defense is hard. Now, the enemy is in virtual space and an attack could come from anywhere. How could we possible set a good defense for that? The United States is scrambling to get good new Cyber Warfare tasks. U.S. Cyber Command (CYBERCOM) is America’s Cyber offensive and Cyber defensive military command. CYBERCOM has many tasks that can detect and patch security holes as well as creating new network systems for the military’s computer systems. CYBERCOM engages in offensive warfare and work on cyber weapons that can be combined with Special Operations Missions, or airstrikes. This is the first step to the protection of our great nation, and will prevail over our enemies when it gets the support it needs. New warfare means new tactics. I think that education is really the best way to go with this oncoming threat. Educate the citizens through websites and other essays like this one, and they will respond. Some will understand computer code, some won’t. But that can change through education. Another advantage is that physical strength is no longer a requirement- and we can face this cyber security threat head-on, to protect our nation and its citizens. Again, cyber warfare is happening right now, and is a serious threat. We need to prepare for this new weapon, and prevent our nation from another Pearl Harbor.

Scriabin write about his aesthetic and style for vers la flamme and Term Paper

Scriabin write about his aesthetic and style for vers la flamme and poem of fire - Term Paper Example Although he had small hands, Scriabin became a recognized pianist; he was so fascinated with piano and even ended up damaging his hands at one point because of practicing pieces, which were meant for greater hand spans than his. Scriabin was interested in both Nietzsche's ubermensch theory and theosophy and this played a great part not only in his musical thoughts but also in his music. He also gained interest in Delville's Theosophist movement when he lived in Brussels between 1909 and 1910. Scriabin is believed to be â€Å"the one great pioneer of the new music of a reborn Western civilization, the father of the future musician," (Garzia 277). Alexander Scriabin wrote his poem, Vers la flame (piece 71), towards the end of his life. The piece has very simple melody mainly made up of descending half steps. However an intense, fiery luminance is achieved by the use of remarkable harmonies and complex tremolos. For this reason the piece is considered a poem and not a sonata (Tatarkiew icz 13). Although the piece was meant to be Scriabin’s eleventh sonata, he was forced to publish it much earlier due to financial reasons. Impression when Performed with Accompaniments Scriabin’s compositions in "Vers La Flamme", like his other works, tend to be very unique owing to the artist’s special attention to accompaniments and instruments in the course of his composition. Many of the occasions, symphonists often reflect special emphasis and attention on the symphonic bit of the music as compared to the instrument, in order that it is not dominated by the instrument. On the other hand, Scriabin’s â€Å"Vers La Flamme" and "Poem of Fire† are largely influenced by the composer’s fascination with piano, reflecting more of his piano thinking and still leave a good sense of balance between the instrument and the symphony. According to Leonid Sabaneev (32), Scriabin had designed the symphonies such that they turned out to be so clear and im pressive when performed on the piano. He states: â€Å"The impression was unforgettable, and it sounded much better than with an orchestra."(Sabaneev 32). Thus, these symphonies have been described as having been written and best meant for a piano solo by Scriabin when he was doing the composition (Bowers 335). According to Vladimir Horowitz, a prominent pianist, Vers la flame was inspired by Scriabin’s unconventional belief that the world would be destroyed by accumulation of heat. The title itself, coupled with the emotional upsurge throughout the poem points to the sizzling destruction of the earth. As already pointed out, Scriabin was interested in both Nietzsche's ubermensch theory and theosophy and this played a great part not only in his musical thoughts but also in his music. Vers la flame therefore expresses and reflects Scriabin’s intensifying and deep philosophical convictions, particularly as at the time that the symphony was being composed. Macdonald thus comments that â€Å"†¦ he (Scriabin) later saw every composition as the expression of his mental world and attached much importance to the meaning, whether mystical, philosophical, or fantastic, of each piece† (33). The incorporation of philosophical aspects, intense, fiery luminance achieved by the use of remarkable harmonies and complex tremolos in the poem lends it a high degree of aesthetic appeal and makes the

Social network marketing Research Paper Example | Topics and Well Written Essays - 1500 words

Social network marketing - Research Paper Example A good communication network can give an organization an upper hand in the advertisement sector; this can either be marketing or conveying urgent information to the public. In an education institution for example, it is very useful in educating people, a good communication network can be used efficiently in conveying information to the students. It attracts even those people who are not even directly involved in the institution hence it reaches out to a large area network. In the past the means of communication were not so advanced and it took long to convey information to a wide area network, this, however has changed over time and the communication network is getting more and more efficient such that you can reach anyone you like , anywhere and with very minimal time (Bosari, J. 2012, pp 53). The social media has been the core of communication in this era, hence for an institution it is very recommendable that there is a social media means of conveying information to the members an d public. Social media is the best tool for marketing available to the people right now, communication is simplified, and there are minimal delays. However for one to come up with an efficient social networking site it takes a lot of dedication and patience, it is not built in a day and one has to work hard to make their social network site efficient in the field. Social media marketing is a branch of internet marketing that entail the use of the internet to reach out to other people. Social network marketing therefore is a fundamental tool for an organization aiming to maximize on their marketing chances. Social media networking is open to many different form of communication, this include; the use of video calls, audio or voice messages, and written messages. This is possible when using social sites to convey information (Cambia, E. Et Al. 2011, pp 59). It goes without doubt that social media networking is the most efficient method for educational institutional marketing, in addit ion to the many advantages of social media; it also gives the liberty to navigate through different links and access more information from the internet. It can be used as a way of uniting other communication networks. The advantages of social media marketing are almost limitless; this mode of communication gives room for even very small corporate or business entities to, market their products without any form of victimization so long as they have an effective social media account, one that can be easily accessed by many individuals. Engaging in online conversations is a very effective way of using the social media to convey information to individuals (Deis, H. & Kyle, H. 2010, pp 87). One could also use the social media to combine it with other promotional brands to better their products; it gives room for research on the products and gain extra information on the marketing strategies. Corporations invest in stock market to generate money from dividend income and to obtain equity appreciation. During the last 10 years the average return on stocks was 3.5% (Soundmoneymatters, 2011). DQ2 The fair market value argument is something that accountants have pondered for a long time. One would assume that the fair market value of a stock should be the absolute law when accounting for equity investment since the market value is the price that everyone uses when selling or buying a particular stock. The problem is that accountants must keep in mind the conservatism principle and the historical cost principle. In my opinion the best accounting practice is to value a common stock investment at historical cost independent of the fluctuations in market price of a stock. If a company does not intend on selling a stock in the near future the market value has no relevance. Making adjustments based on market value would be a troublesome task for accountants. At the moment that a company decides to sell a stock a company will either achieve a loss or gain based on the difference between historical cost and market value. College Life Student - Essay Example The theory of oscillatory selection could be one of the first phases of evolution that we may go through . This theory explains the oscillation of a specie between two different environments with the aim to be in the best suited environment at a given point in time . If we consider our groups of friends we hang out in college with, we would realise that they are generally divided into two if not three . One group would represent the studious kind and the other the fun loving kind . There is always a marked difference between the characteristics of both the groups such that they can never merge and we as an individual would opt to be a part of only one group at any given point in time. When an individual wants to be recognised as the "hottest guy" in college or "Mr cool", which is generally the case in the initial years in college we want to be seen as a part of the "fun loving". But when we have assignments to submit and deadlines of work to be met with we shift over to the studious kind for help The theory of convergent evolution explains the acquisition of some traits by a specie,

New and Better Knowledge After a Trip to The Evans Group Essay Example for Free

New and Better Knowledge After a Trip to The Evans Group Essay A visit to â€Å"The Evans Group, a fashion development and production house catering to various designers have changed so much beliefs that I had before. As a Fashion Design student dreaming to have my own fashion production company someday, that trip that we had made me learn many things that as a sophomore student like I do not have enough knowledge of. I used to think that fashion designing is all these efforts I am putting into my studies but I was proven wrong with what I have observed when I have seen the reality at The Evans Group. All along I have thought that if one is a very good fashion designer, it is all what it takes and it is all what one aspiring designer needs. Again, I was wrong.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The Evans Group (the Company for brevity) offers services to clients such as design developments, first patterns, samples, duplicates, production patterns, gerber pdm tach packs, yields, grading, marking, hand finishing, small volume production (20-300 pcs/style), trimming, fabric sourcing and wolf dress form rentals.. The company was named newsmakers of 2007 and has a new production facility in Los Angeles and a development studio in San Francisco.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   With the many things that we have seen and learned from the Company, I am writing here the top ten that I strongly believe need to be shared and worthy to be taken into consideration by designer students like me.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   First, I have learned that a very good system and organization what makes such a business grow and stay in existence. When I have seen that the company takes care of the specific requests of each designer customer it made me realize that a very meticulous attention should be given to each request. A poorly followed instruction may mean a lost client and a lost income. In the factory, I learned that each company has different policies for their orders. Even it is as unnoticeable as the label and the hemline structure, they are as equally important.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Second, I used to think that patterns are such an old fashion style when experts are doing the cutting. But NO! Patterns are still very important and they serve a big role in the success of each cut fabric and design.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Third, Budgeting is very applicable and useful in the factory. A knowledge of fashion designing alone would not make one designer successful outright. A knowledge of little economics, little of budgeting and much of common sense are the very basic ingredients that go with the fashion designing talent. At The Evans Group, if they have a plaid fabric, the staffs match the quality with the budget allowance required. Greater budget allowed means better quality.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Fourth, technology nowadays are indeed inevitable. I have seen that Tukatech, the company’s computer arm plays a big role in the success of the business. It is a computerized designing arm capable of making the designs.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Fifth, like any other discipline, the world of fashion have their own set of â€Å"jargons†. In the factory, they used the terms such as unit to identify a piece of work. Moreover, I have seen and learned what a fusing machine is.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Sixth, a knitted fabric shrinks. Tthus, it needs block fusing. Unlike ordinary fabrics that simply needs piece fusing.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Seventh, I and my group have observed about cross cutting. Cutters cover the roll of fabric with nylon then they place rolled fabric in a machine where a   ruler is attached and they can cut that in sizes like one inch or in any size they want. Eighth, .management is also important in fashion industry. In The Evans Group, they have various departments like cutting, sewing, printing among others. Only a properly managed company with good department leaders, managers or supervisors can stay long in the business. Ninth, marking the fabrics for cutting is very important. A marker must not go wrong with this job. He or she must consider the sizes that have been given by designer client: for instance, 2S, 2M, 2L,2XL when that client have specified an amount of fabric to use. Arithmetic and proper geometric talents are needed here. Lastly, I appreciate the visit to The Evans Group. It made me learn so much. Indeed, learning is not limited inside the four corners of a classroom. The best way to learn is to experience!

Thanks For Not Killing My Son English Literature Essay

Thanks For Not Killing My Son English Literature Essay With hundreds of newspaper publications printed everyday, television, and Internet, you might ask yourself why do you need to read a short essay published in a college English book. Well, I decided to tell you the true story about this short essay. More importantly, I will tell you why you should read it. The essay Thanks for Not Killing My Son by Rita Schindler stands out from the crowd because it is emotionally intense, abundant in visual sentences, and very thought provoking. First, Rita Schindler combines attention-getter with persuasion technique in just 38 lines, each of them delivering full-impact feelings, making this essay intense and effective. The title is written in a way that immediately catches your attention. Thanks for Not Killing My Son its not a form to express gratitude to someone, but is instead used as irony. The constant repetition of the thank you will make you wonder at the mothers non-violent response to her sons beating, and also builds emotion in the end. However, by the end of the essay, when the mothers thanking becomes a pattern you begin to understand the patience and compassion of a loving parent. Using implied fright through the entire essay, Schindler creates another kind of emotion for the reader. When she says à ¢Ã¢â€š ¬Ã‚ ¦thank you for this eyesight, his hearing and his hands which you could have easily crushed. (Schindler 8), you may think that a similar attack can really affect you or someone you care about. The whole argument raises to a climax in the final point, which suggests the ultimate loss to parents, the death of a child. When the author says, You could have kicked him to death, but you only left him to die. Thank you. (Schindler 11) she alludes to what might well have resulted from the actions of the attackers. However, by the time you finish reading this essay, itll reveal to you a final emotion; she leaves death to the end, since its a thought she would not like to ever contemplate or experience (Schindler 11, 12). Secondly, you will find this essay abundant in visual sentences, making this another effective way to grab your attention. As soon as you start reading this essay, I can assure you that youll realize how powerful those visual sentences are, and you dont have to read too much. He was left lying in a pool of blood from an open head wound (Schindler 3) is the beginning of the third paragraph and reflects immediately the ferocity of the attack. Moreover, its not just the brutality of the attack itself, but the cruelty of leaving someone unconscious lying on a park alley in the middle of December. Reading more, you realize that this idea of using visual sentences becomes more frightening because the author has used specific examples of actual events instead of talking in general about the nature of violence (Schindler 5, 6, 7, 9). Finally, the essay is very thought-provoking and it raises many questions for you to think about. Since the attack against his authors son happened à ¢Ã¢â€š ¬Ã‚ ¦sometime between 1.30 p.m., Dec. 8, and 1 a.m., Dec. 9,à ¢Ã¢â€š ¬Ã‚ ¦in the Victoria Park-Terraview area, the first thought that will cross your mind will be about the sense of security and law enforcement on the streets of Toronto. You can think about this when you read this sentence: à ¢Ã¢â€š ¬Ã‚ ¦when his friends were talking about revenge, I heard him say, No, I dont want someone elses mother to go through mine has (Schindler 10). Our society needs to change the way we enforce the law, so revenge should not be our concern. The essay is also relevant to our times because it makes you think about todays parental guidance related to street violence. Apparently, you may say that is no connection between those two, but when Five guys and two girls à ¢Ã¢â€š ¬Ã‚ ¦beat one person definitely shows that parental guidance was n ot effective in this case. Any parent must exercise constant guidance and attention to their kids, and you can found this idea in the last sentence of the essay: I hope that someday youll have children and love them as much as I love mine- but I wouldnt wish on your child what you did to mine. (Schindler 13). In conclusion, reading Thanks for Not Killing My Son you will discover an emotionally intense, full of visual sentences, and thought-provoking essay. Giving you those reasons to read Rita Schindlers essay, lets make an effort and prove that the following rhymes from a well known song are wrong, and we can change our amazing world that we are live in. Theres somethin wrong with the world today. I dont know what it is. Somethings wrong with our eyes. / Were seeing things in a different way, and God knows it aint His. It sure aint no surprise. Were livin on the edge.  [1]

William Shakespeares Authenticity Essay -- Shakespeare Playwright bio

William Shakespeare's Authenticity Over the past several centuries, many scholars have been debating the authenticity of Shakespeare and his works. Many books have even been published questioning if the legendary playwright from Stratford is the author of his many plays and poems. This theory still remains as a possibility today and much of the evidence stems from Shakespeare’s great literary achievements, his humble beginnings, his inadequate education and the missing chapters in his life. Throughout his writings, there is evidence of similarities between the language and literature of the time period with subjects such as law, history, politics and geography as well as manners and knowledge of the courts which would not have been known by a common citizen or the son of a tradesman. The range of knowledge which he displays would only be expected of a man of extensive education during the time period that was familiar with the royal figures that are depicted in his works. The insufficient records have added even more mystery as none of the original manuscripts have survived and were possibly destroyed to conceal the identity of the actual author. Although Shakespeare is considered by many to be the greatest playwright of all time, much speculation surrounds his authenticity through theories based on linguistic and historical problems as well as criticism. Since the four centuries that have passed since Shakespeare’s times, several theories have been developed which claim that others may be the legitimate authors of his works. The playwrights usually focused on are Francis Bacon, Edward de Vere, William Stanley, Roger Manners and Christopher Marlowe. Other theories support the fact that perhaps sev... ...e’s works which allow for authentic spectacle and realism with all of the available modern theatre techniques at their disposal. These presentations have led to different forms of media such as opera, ballet, sound recordings, television and movies. Even musicals have been created with "The Taming of the Shrew" acting as the inspiration for "Kiss Me Kate" while "Macbeth" acted as the inspiration for a political satire called "Macbird!" In "Hamlet" it is said that the reason for theatre performance is to â€Å"hold the mirror up to nature.† To most, this is exactly what Shakespeare has done with the lasting impressions left by his works from their first productions to the latest versions. While Shakespeare’s influence is undeniable, many factors still question his genius and intellect as a legitimate author that still fascinates literary enthusiasts today.

The Power of Personal Goals Essay -- Personal Narrative, informative e

The life of a student-athlete entails much sacrifice and plenty of restless days. Whether frantically finishing homework following an all-day competition or dreading to begin a project as injuries are tended to, such a lifestyle is not suitable for the fainthearted. In realizing the amounts of work that is demanded of the student-athlete, one can indubitably feel overwhelmed. However, levels of preoccupation and tension lessen considerably when organization guides the daily course of action. Implementing a set of long-range goals, in any realm from academics to athletics, is essential to attaining success. In setting educational goals to be reached, I strove diligently to achieve those high standards and, eventually, realized them. As a young, elementary school kid, I wanted to grow up to be any one of three things: fireman, doctor, or professional athlete. If the day was unbearably warm, as it usually was during the non-winter months in the Los Angeles Basin, I thought being a heroic firefighter would be a great occupation. If recess involved a cut from a fall onto the blacktop or a scrape from a viciously thrown dodgeball, the image of helping others physically surfaced into my mind. During the football season, boyhood dreams of playing in the National Football League were envisioned. Yet, as I matured, I realized that vacillating between playful whims would inevitably result in boredom. I began to understand that my decisions needed more substantial reasons and purposes. I had to formulate concrete ideas that had an objective to be reached in the long run. As I reached the junior high years, there were circumstances that I had yet to experience. I was accustomed to having my basic needs met by parents, i.e. food, clothi... ... test and tedious assignment by reminding myself what the cause was. When the clamor of the alarm woke me to the new day, my motivation to trudge out of bed was the opportunity to work toward my goal. Knowing that the reward was head, the drive to obtain it did not allow for obstacles to halt my journey. During the process of receiving an education, the daily routine of attending class can be a deterrent to keep one from becoming successful. There will inevitably be times of stress, and the desire to quit will arise. Unless the aim is deemed worthy enough, the necessary sacrifices will not be made. Therefore, one needs a substantial end to be sought so that the difficulties will be met and surmounted. Set an objective to seek and seek it without reservation. I was able to realize my dream of being educated at State University by placing it as the loftiest goal.

A Review About HR Department Architecture Essay

At its petroleum, endowment direction( TM ) is a affair of expecting the demand for human and so puting out programs to run into it1 ( Cappelli, P. 2008 ) . In this short essay, I will be composing a response to the above proposition. Although the construct of TM late instigated in the current economic conditions, it is instead apparent that in most administrations where HR section fails to follow the rules and patterns of TM, it comes up short in footings of corporate public presentation when compared to a company that patterns TM( this impression is clearly supported in fig 1 with mention to appendix 2.0 ). NHS for illustration is presently at its early phase to implant TM. It has placed importance upon constructing an grasp upon planetary best pattern and orienting it for effectual application. The research conducted by hired institute of forces and development ( CIPD ) claimed that although, ‘It is recognised that while constructing a robust and systematic methodological analysis is critical in deriving ownership from stakeholders, the existent benefits will merely come through effecting cultural alteration evidenced in the acceptance of a endowment mentality † ( CIPD, 2006 ) .Refer to appendix 1 for full elaborate study. There are a scope of jobs company faces with work force direction. This include ; deficit of endowment, cleavage of work force, direction of hazard and uncertainness etc. With an effectual TM system, company can cut down these jobs. As antecedently stated, the most common response to TM is to expect no demands at all ; do no programs for turn toing them rendering the termendowment directionmeaningless. The 2nd most common exist amongst large companies. They rely onstructure-centricattack with complex and bureaucratic theoretical accounts which in the current epoch of volatile environment had failed due to inaccuracy and high cost. The new attack to TM takes into history the great uncertainness faced by concern in current Labour market ( Cappelli, P. 2008 ) . As such, my response will germinate around the best practices/new attack available to any administration to accomplish excellence in its endowment direction attack i.e. a suggested solutions to the HR crisis with respects to pull offing its work force. First, I am traveling to touch on therecruitment/developmentfacet of TM2. Recruiting was focused through assorted communicating channels such as classified adverts, college arrangement offices, internal occupation station systems etc. All of which created a job of penchant and geographical restriction. However, due to technological promotion, companies have been able to reach wider audience of endowments that meet its demands. An illustration is monster.com ( the taking supplier of online callings and recruitment resources committed to linking administrations with persons ) .3 Puting merely nevertheless, it is more cost effectual to develop and retain direction endowment than enrolling from external markets. Research at Ernst and immature estimated the mean cost of replacing at $ 1 million ( Atkins R. et Al. 2004 ) . As a consequence, companies should endeavor to develop and retain staffs instead than external recruits. Although most companies preponderantly smaller one time would reason that provided an employee had been trained, what is to maintain such employee from running to other companies with better offers? Well my reply to this would be there is no barrier forestalling employees from taking trades that will advance their calling waies. In fact surveies by the confer withing house Watson Wyatt reported that, people who are late trained decamp from the administration to do more efficient usage of those accomplishments ( Cappelli, P. 2008 ) . However, Peter Cappelli in his ‘new manner of believing about TM theoretical account ‘ tackles the hazard involved in developing employees to a grade of satisfaction. He developed what he calls aproposition kindred to just-in-time constructi.e. a talent-on-demand model. Within this model are four rules. Thebrand or purchase ruleclearly saying that, an optimum attack would be to utilize a combination of internal and external recruits. The challenge would be calculating out precisely how much of each to utilize. P. Cappelli recommended that administrations should purely remain off from utilizing long term prognosis as the volatile market renders it inaccurate. Rather, it should concentrate on short term demand for talent4.The 2nd rule claims that houses needed toadapt to uncertainness in Talent Demand ;one manner is to interrupt up development plans into shorter units instead than set direction trainees through a 3 twelvemonth functional plan. The 3rd rule is to better thereturn investing in developing employees ;one manner is to necessitate employees to portion in cost of development through voluntary hours i.e. hours spent on preparation will non increase employees payout. Employers have besides been more inclined with ways to cut down development cost by maintaining employees longer5 ( P. Cappelli, 2008 ) . The concluding rule requires houses tocontinue the investing by equilibrating employee-employer involvements.Possibly, the chief ground talented employees leave an administration is due to detecting better chances elsewhere. As such, the key to continue your investing in development is by equilibrating both parties involvement ; leting employees to portion in advancement determination is a good illustration as employees want chances for promotion and control over their career6 ( Peter Cappelli, 2008 ) . Other theoretical accounts such as L.A. Berger ‘s 3 chief TM procedures are besides really good for an admini stration to adopt7.A drumhead figure of this faculty can be found in appendix 2.2 followed by elaborate note explicating what it represents. I will now see the issue ofassessment and public presentation directionand its impact on TM.Endowment Reservoircan besides be used unalterably with TM as its aim is to construct a pool of high talented people capable of back uping administrations current and future concern demands ( Berger, L.A 2004:5 ) . Inside this reservoir are assorted talent appraisal tools ; one of which is public presentation assessment ( PA ) . PA exist to let appraisal for preparation demands, reappraisal past public presentations, set public presentation aims etc. The purpose of PA is to bring forth different type of assessment that will let single to see themselves as making the occupation better. There are assorted types of PA tools, two of which are ; 360 grade feedback and forced ranking. The latter will be touched upon inappendix 3. 360grade feedbackallows for what has been losing in modern twenty-four hours assessment ; the sentiment of co-workers and equals etc. 360 degree feedback allows for multiple angle of perceptual experience i.e. everybody working with a peculiar person in a house are required to give feedback on such single normally through a study. This theoretical account was developed farther into a 540 grade feedback by leting external bureaus into the image. PwC went excess lengths by developing its ain 720 grade theoretical account which involved household and friends in the assessment procedure as it believed single externals enterprises outside the companies knowledge can be best justified by household and friends. Although it is of import to follow a theoretical account of measuring endowments in a company, it is more of import to observe the cardinal characteristics of a good assessment which are ; relevancy ( should speak about your occupation ) , sensitive ( can distinguish different type of behavior ) , operable ( able to set into usage ) , dependability ( can be used to mensurate public presentation at given period ) etc. Both forced ranking and 360 degree feedback are non perfect theoretical accounts to use. They have been capable to critics in the yesteryear.Refer to appendix 3. Last, I will discourse wages in relation to TM. At the perpetrator of wages in an administration, wage construction should be designed to suit specific intents, it should be internally consistent, integrated with other HR procedures, governable and manageable, accepted as just and just and eventually it should be flexible. Benefits are an intrinsic portion of the value proposition that administrations offer new and bing employees. Research published by The Economist Showed ; â€Å" wages and employee benefits still rank highly extremely in planing a new value proposition for tomorrow ‘s work force ( 56 % & A ; gt ; , second merely to supplying a better work-life balance through offering flexible working agreements in footings of hours and topographic point of work ( 62 % ) . Structuring a flexible benefits programme so staff can choose the inducements that suit their life style is a cardinal arm in the armory of talent direction and the keeping of star employees. The ability to blend and fit benefits, from pension ‘s and child care, to vacation allowances and gym ranks, plays a cardinal function in pulling endowment. † ( Williams, D. 2008 ) . As mentioned in the development subdivision, it is of import for an administration to honor its gifted employees with actual and perpendicular motion within the house to let for keeping ( S. Rousseau, 2008 ) . Rivals in similar industries will be looking to get the best gifted persons from one another particularly in this current clime of planetary recession. Companies require gifted person to assist them stir farther off from insolvency. As such, retaining such single should be precedence in any company. To reason, talent direction is non merely nice to hold, it is critical to every administration. Talent direction is required to pull off keeping ratio. Effective TM will let for decreased enlisting cost on external endowments. The above prostration suggests how administration should work across the full spectrum of Talent Management. Traveling back to the inquiry, it is of import that talent direction should non be seen as merely an HR enterprise. HR function is to ease the direction of endowment and to move as managers and advisers to line directors. â€Å" HR executives and directors must work together to associate concern scheme with the endowment needed to put to death it † ( Atkins, R. et Al. 2004 ) .BibliographyAtkins, McCutcheon, Penna. ( 2004 ) : ‘The Talent Management Imperative: A Best Practice Approach ‘ , Available at www.compassess.biz [ Accessed 08 March 2009 ] . Berger, L.A. The most common are the A, B, C participants e.g. A=20 % of work force, B=70 % , C=10 % . From a TM nomenclature we can mention to this as super-keepers 5 % , Keepers 15 % , solid citizens 70 % , and Poor performing artists 10 % . Argument in favor of forced ranking implies it free up administration by allowing off hapless performing artists which enable distinction in the administration e.g. if at top degree, an person is executing the worst, there could be better persons lower down the hierarchy to make full in and execute better. The bottom side nevertheless is, forced ranking is non legal as it fails to administrate one to one grounds and records. It can be nevertheless used to do superior determinations particularly in athleticss. 1. In its broadest sense, talent direction can be used to depict the designation, development, engagement/reflection, deployment of endowment within a specific organizational context ( CIPD, 2006 ) . 2. Research from DDI found that merely 1/3 of executives believed that their administration ‘s leading capablenesss look promising, while 82 % of companies reported holding a difficult clip happening qualified leader campaigners ( Atkins, R. et Al. 2004 ) . 3. â€Å" Monster.com, with 36percent of the worldwide web calling market, is the largest by far of the overplus of on-line calling web sites. In the 3rd one-fourth of 2003. Monster had 16.7million alone visitants who stayed an norm of 15.6 proceedingss. By September 2003 † ( Fredrick, D. et al. 2004 ) . 4. Leading corporations such as capital One and Dow Chemical ‘s have abandoned long-run endowment prognosiss and moved toward short term simulation ( Cappelli, P. 2008 ) . 5. About 20 % of U.S. employers ask employees who are about to subscribe a contract stipulating that if they leave the concern before certain clip, they have to pay back the cost ( Cappelli, P. 2008 ) . 6. A fictional instance affecting a company called Sambian Partners and its gifted employee Tom Forsythe ( who has been shortlisted for top public presentations by the executives ) saw Tom resigned for a better place with the arch challenger of the house. Several issue interviews were carried out in an effort to retain Tom but attempts were ineffectual. Tom left go forthing the direction to chew over on what went incorrect. One of the staff made a remark stating â€Å" I merely think he looked above him and realized he was traveling nowhere fast. No 1 on the executive squad is even close to retiring, and the org chart is top-heavy as it is. Where ‘s the calling way? † ( E. Edwards, et Al. 2008 ) . Possibly if Sambian Partners had considered the P. Cappelli theoretical account or other similar theoretical accounts, things could hold been different.

Probate Code Essay

There is significance in property being classified as probate or nonprobate property in terms of the need for probate, creditors’ claims and payment of federal estate and state estate and inheritance taxes is that. If property is classified as probate then that means that it is the decedent’s property that is subject to estate administration by the personal representative. It also means that the probate property is subject to creditors’ claims and federal and state death taxes. Nonprobate property is not subject to probate because it cannot be transferred by will or inheritance. The nonprobate property goes straight to the named beneficiary or to the surviving joint tenant(s) or partners. Nonprobate property is part of the decedent’s gross estate for federal and state death tax purposes; it is subject to federal and state estate taxes and state inheritance tax. 27. Joint tenancy is different from both tenancy in common and a tenancy by the entirety. Joint tenancy is different from tenancy in common because joint tenancy is the ownership of real or personal property by two or more persons with the right of survivorship; whereas, tenancy in common is the ownership of an undivided interest of real or personal property by two or more persons without the right of survivorship. In a tenancy in common, each person has the right to hold or occupy the whole property in common with the other co-tenants, and each is entitled to share in the profits derived from the property. Unlike a joint tenancy, when a tenancy in common dies, the decedent’s interest goes to an heir or as directed in a will. Joint tenancy is unlike tenancy by the entirety. Tenancy by the entirety is a form of joint tenancy with the right of survivorship available only to a husband and wife. It cannot be terminated by one joint tenant’s inter vivos conveyance of his or her interest. Neither one of the tenants by the entirety can transfer the property or sever the tenancy by the entirety without the consent of the other spouse. 28. There are four unities required for the creation of a joint tenancy. Those unities are: unity of interest, unity of title, unity of time, and unity of possession. For unity of interest to exist, each tenant must have an interest in the property identical with that of the other tenants; the interests must be of the same quantity and duration. For unity of title to exist, the tenancy must be created and the tenants must receive their title from a single source, e.g., the same will or deed. For unity of time to exist, joint tenant owners must receive or take their interests in the property together, i.e., at the same time. Finally, for unity of possession to occur, each joint tenant must own and hold the same undivided possession of the whole property held in joint tenancy. 29. An ancillary administration is necessary if at death the decedent-testator owns any real property in a state other than his domiciliary state, and any tangible personal property in another state. The purpose of ancillary administration is to dispose of and distribute that portion of the decedent’s estate located in a state other than the decedent’s domiciliary state. 30. Community property is all property, other than property received by gift, will, or inheritance, acquired by either spouse during marriage that is considered to belong to both spouses equal in the nine community property states and Alaska if community property is elected. Things that would not be community property includes property received by gift, will or inheritance that are acquired by either spouse during marriage, property individually owned by the husband or wife before their marriage, property that is currently separate property and is traded, replaced, or sold for other property and becomes â€Å"new† separate property, and lastly, social security, railroad retirement, and veteran’s benefits.

Working for Community Gains Leader Recognition Essay

Working for Community Gains Leader Recognition - Essay Example This is the concern of many fire chiefs throughout the country and one that was shared with community leader Whitney Laning more than a year ago. Unlike many, though, Laning took action, learning what kind of help firefighters needed to provide the community with greater safety and moving forward to organize this support. For the past year, Laning has worked tirelessly to bring together the Rowlett Citizen Corps Council (RCCC), a nonprofit group dedicated to finding funding for the CERT program and equipment, and the Community Emergency Response Team (CERT) in the city. He was working to make the community a safer place for both citizens and emergency respondents, but his efforts were recently recognized in a big way. Laning was named one of the Five Outstanding Young Texans at a special black tie ceremony held in the state capital. â€Å"It was very rewarding and humbling to be in such company with these great folks that are doing such tremendous things around the country,† Laning said. Past recipients included George H.W. Bush in 1956 and Henry Cisneros in 1976. The primary program is the CERT program. This organization functions during normal emergency situations by providing canteen services to the firefighters – giving them cool drinks, food to help them keep up their strength and a cool place to rest when fighting a long-term fire. However, those trained in the CERT program are also able to jump in and lend a hand when required at times when emergency personnel is overwhelmed. â€Å"If we had a large scale disaster like a tornado come through here, it could be 24-72 hours before we received any kind of state of federal assistance. That’s where these citizens will be able to make a real difference,† said Fire Chief Larry Wright. As part of CERT, citizens are trained in first aid, damage assessment, evacuation procedures and even some light search and rescue. Laning’s leadership in these  programs has been instrumental in obtaining the multiple awards and recognitions each program has received to date, according to Greg and Lisa Peoples, the Junior Chamber of Commerce members who nominated Laning for the award.  Ã‚

The Distinction Between Common Law and Statute Law Essay

The Distinction Between Common Law and Statute Law - Essay Example 4. The appeal dealt with three salient aspects – firstly, whether there had been an oral agreement between appellants and respondents to share the costs for the pumping station (b) whether there was a common obligation on the part of appellants and respondents to augment the sewerage supply system and whether the appellant was entitled to reimbursement from the respondent for his contribution (c) whether the trial judge’s order on costs for the counterclaim was to be set aside. 5. The appellants argued about contribution under a common obligation to construct the pumping station, such that respondents were obliged to reimburse Appellants for their share of the cost of the station. 6. The Court rejected the Appellant’s appeal of the District Court decision declaring that contribution under common obligation did not arise and ordered the Appellants to pay respondents their appeal costs. However, where the counterclaim of the Respondents was concerned, the Court dismissed the trial court’s order on costs and ordered respondents to pay Appellant’s costs on the counterclaim. 7. In a civil law case, the burden of proof requires the Plaintiff to produce evidence that will convince the Judge of their entitlement to receive relief. The requirement, in this case, was the evidentiary burden of proof, to support the Plaintiff’s claim for contributory costs. 8. One of the cases that were considered in this Appeal was Cockburn v GIO Finance Ltd (No 2) (2001) 51 NSWLR 624, where the views of Mason P at 631 that the right to contribution depends on matters of substance not form were taken into consideration. (b) The ratio decidendi, in this case, was whether the entitlement to contribution arose out of common obligations or coordinate burdens and obligations created by the Deeds since contribution depends on substance not form. The judges that no such obligation had arisen given the circumstances of the case.

Assess Benjamin Franklin's contributions to science Research Paper

Assess Benjamin Franklin's contributions to science - Research Paper Example Science is one of the most important fields for development. The world before the 18th century has been described as a primitive world, where people depended on manual ways of during things. The contribution of science was not given the attention it deserved. It was until the 18th century that science became an important field of study for the development of Europe and America. This began with Isaac Newton’s discovery of the law of gravity and light. Newton’s discoveries inspired other scientists, including Edward Jenner and Joseph Priestley who later made important scientific discoveries in medicine and chemistry respectively (Fisher 12). In fact, 18th century comes out as the century that several discoveries were made, including steam engine, cotton gin, mercury thermometer, gas lighting, and hot-air balloon just to name but a few. Benjamin Franklin is among the great American scientists of the 18th century whose contributions in science have been of great importance to the world, several years after his death. Life Benjamin Franklin was born on January 17, 1706 Boston, Massachusetts to a poor family comprising of his father, Josiah who happened to be a candle maker and Abiah, his mother. He was the fifteenth child in their family. Franklin was not lucky to have a formal education. He only managed to attend school for two years before being sent home for lack of school fees (Murre 15). However, since his family was too poor to afford the school fees required, Franklin abandoned school and resorted to helping his poor father in candle making. Nonetheless, since he had interest in having good education, he taught himself how to read and write, as well as how to experiment. Since his family could not afford enough money to feed the entire family, Franklin began working as a printer in Boston to boost his family income. Even though he was working as a printer, he still had a lot of interest in education. As such, he kept reading books and periodicals at night after leaving work (Canada par. 3). The more he continued practicing reading and writing, the more he developed good grammar and style of writing. However, when he was about 17 years of age, Franklin resigned from the print shop where he had been working as a printer. This is after he had gained a wealth of experience in typesetting skills. He then left Boston for Philadelphia, where he arrived very hungry and tired (Murre 18). It did not take him long before getting a new job in Samuel Keimer’s printing shop. Here, he demonstrated great skills, which earned him good salary. At age 22, in 1978, he started his print shop in partnership with Meredith. Few years later at the age of 24 year, Franklin met Deborah, whom he fell in love with, married, and were blessed with two children named Sarah and Francis Folger. His printing business became a great success, transforming him from a poor boy to a wealthy businessperson. In fact, his success in printing business made him become the

Child Labour Essay Example for Free

Child Labour Essay I.INTRODUCTION In a developing country like the Philippines, the child labor phenomenon remains widespread. Today, we find hundreds of thousands of Filipino children being deprived of the oppurtunity to share in the prospects of development. The door of the opportunity is close on them simply because their â€Å"childhood is wasted in premature work (ILD 1994) rather than nurtured in school and at play. And doubtedly, many stand witnesses to this bleak scenario in the workforce. How the lives of this children are apparently placed at risk and how they are clearly cheated of their basic rights and privileges have stimulated a sounding call for an immense public awareness and a prolific action on the child labor issue. Child labor is a â€Å"long standing problem† (ILO 1993: 26), that has been rapidly creaping from the midst of economic, social, and moral crisis. Hence, this papers generally aims to propagate awerness about child labor particularly, the current situation her in 6the Philippines. It has three major objectives. First, it intense to present current facts and data about the child labor condition in the Philippines. Second, it attempts to discuss significant points about the child labor issue. And finally, it aims to waken concern individuals and bring fort a worth while realization, concern, and utmost action and this matter. A.What is child labor? Filipinos re smilingly wide aware of the prevalence o child labor here in the Philippines yet, knowingly or unknowingly, many remain inadequately informed and aware of child labor’s real score. The idea of child labor would concretely leads us to a common general notion, that is, children being abuse through forced labor. This is the concept, which inevitably sticks to anyone who hears about the issue. Hence, we must remember that child labor implies a broader concern so purposely, there is much to be adhered about child labor and what it substantially means. To further understand this concern, let us set answers to these questions: When is child labor considered ethical? Illegal? Child work refers to gainful work of children below15 years of age ( Torres 1995 :2). It means the production of goods and services either on a full-time or part-time basis as performed by children in both the formal and informal sectors. Recent studies in the Philippine noted child participation in the following areas of work: agricultural plantations, small handicraft shops, home-based sub-contracting industries, commercial establishments, household’s street trades, and other small-scale business ventures. Work among children, is not wrong. Children, as part of the traditional Filipino culture are taught to work at an early age by their families. This true particularly in Philippine agricultural communities were farming is considered a family affair and the farm household is equivalent to one production unit (Torres 1995:2). Work for children however, becomes unacceptable and objectionable if it falls under any of the following circumstances. One, if the work is hazardous to the help and morals of the children such as night work, heavy work, or work in the streets which exposes the children to drug abuse and sexual encounters. Two, if the conditions of work are exploitative, as in instances when they require long working hours, provide low pay, and are used as substitute for adult labor. And lastly, if the work prevents children from obtaining education which is their right and privilege in any society (Torres 1995: 2). Child labor is the illegal employment of children below the age of 15, where they are not directly under the sole responsibility of their parents or illegal guardian or the latter employs other workers, apart from their children, who are not members of their families or their work endangers their life, safety, health, and morals or impairs their normal development including schooling. It also includes the situation of children below the age of 18 who are employed in hazardous conditions. (Representatives 1994:3) B.What is current child labor situation in the Philippines? The current child labor situation in the Philippines has recently raced enormous concern. In the 1995 Children Survey conducted by DOLE, results revealed that about three in every twenty children have worked in the past year. Males compromised two-thirds of the working children. The proportion of working males increases with age. Looking at the sex ratio, the ratio of working male to every one hundred working female increases from 171 for age group 5 to 9 years to 181 for age group 10 to14 years. The absolute increase doubles as the children reach the working age of 15. For age group 15 to17, there are 200 working males for every 100 working females or 2 males for every1 female. (NSO 1995). Working male children out number females in both urban and rural areas. 2/3 of working children lives in the rural areas. This maybe due to unpaid farm work participated in by family members during planting and /or harvesting seasons. Based on the1995 children of the Philippines Survey, Only 69.8% reported to have attended school during school years 1994-1995 and 1995 to 1996. They compromised mostly of male working children (62.5%), out numbering the female working children (38.5%). Working children from the rural areas have higher school attendance (67.3%) tha those from the urban areas (32.7%). Most of these working children reported the same kind of problems encountered in schooling. Ranked, as the first three problems were high cost of school supplies/books/transportation’s, school distance from the residence is too far, and difficulty in catching up with lessons (NSO 1995). Working children inevitably experience multiple work-related problems. Only 2 out of 10 children express that they did not encounter any problem in relation to their work. The rest, however, said that they experienced one or more work –related problems. Among these problems experienced by them are  coming home exhausted from work, doing heavy physical work, work being stressful, boredom from work and that their work is risky or dangerous. (NSO1995). Children remained in the workforce for a common significant reason. Survey results showed that majority or 60.1% of the total working children who prefer to remain in the workforce sited improvement in the living conditions of their households as the main reason for working. In the urban areas, only 56.4% cited improvements in living conditions as the main reason while in the rural areas, the proportion reaches 62%. This is following the notion that families in the urban areas have better living conditions than those in the rural areas. These facts and data justify the growing concern of children labors prevalence to the present Philippine society. C.Why is child labor very rampant in our Philippine society now a days? The prevalence of child labor in the Philippines has been attributed to multiple factors. While poverty is apparently the principal factor. The Philippines being a third world country, â€Å"Child labor is symptomatic of broader social disorganization resulting from urbanization, industrial development, and economic recession, and the shifting models of production† (Torres 1995: 3). With the advent of economic globalization, awareness of the incidence of child labor in the third world nations is growing rapidly in the industrialize counties as the Philippines. Hence, Many Filipino many children work for the very reason that their families are poor. Though poverty is the most significant cause of child labor, other factors greatly contribute as well. Cultural values may also drive children in to employment. Children in Filipino farm agricultural households are expected to participate in farm production. Parents also affirmed that teaching children hoe to work is important and they introduce â€Å"Work – related task as if it work play activities† (Torres 1995: 3). This scenario is likely triggered by the traditional Filipino values of close families ties and  kinship by which each family member is expected to contribute to help keep the family moving and survive. These persuasions make easier for children to accept work as part their routine. It is also a question of social attitudes. The fact that many children work because there is a little else they can do is an educator of ill social attitudes. Schools are unavailable, in adequate or expensive; the education, which is provide is a related to the world of work. The structural adjustments program, which many third world countries have under taken, has also unfortunately ment as serious cut back in investment in the social sector. Political condition also interacts with economic factors that make child labor possible. Counter-insurgency campaigns have lead to dislocation of families, and the lost of parents forcing children to work for their own survival. Undoubtedly, many Filipino children are victims of this grim political manipulation. On the demand side, research show that many children hired because they are more easily exploited than adults are. Employers prefer children because they are docile, In capable of collective bargaining and willing to work to support their family or simply to survive. To have child labor means lower cost because children never complain with very low wages (Weissman 1997: 18). All these, including other minor factors, play a productive part in rapid increase of child labor cases in the country. D.What is the risk faced by working children? Working children inevitably faced intolerance risk. Of millions of children who are working many toil in â€Å"Slave-like† (ILO 1993:54) or Hazardous conditions. There are all too many children in the work force that faced physical risk and hazard to their physical, social, intellectual and psychological development. Survey results revealed that many Filipino working children have suffered from work –related injuries such and other  various risks are affected by this condition: The attention span of children is usually limited and their judgement of dangerous situations may not be to develop. As they are not experience enough to cope with job responsibilities, ling hours of work and other job stresses that normal adults can cope within their daily chores, the impact of psychosocial stresses on a child in understandable more pronounced (GUST 1993:78). In the mere sense, the consequences are intolerably traumatic and devastating. These case of Filipino child: A Filipino, barely ten years old, lost her sight, when another worker carelessly threw his cigarette but near a mound of gun powder that she was inserting into colorful bits of paper. The gunpowder exploited and with it went her sight. Working in sub-human conditions, these children’s health soon gave way†¦ (Junior citizen Ed. 1996:2). Many types of work affect the intellectual and psychosocial development of the child.† Work is detrimental to a child if it deprives him of his normal leisure, play and recreation, worse if he is deprived of his basic rights of education, parenting, and protection â€Å" (Gust 1993:78). Such adverse conditions have been observed in bonded labor such as seen in feudalistic agriculture, in the participation of children in Muru-ami fishing and in domestic work. The projected psychological effects on working children was shown in this specific study: A study on the psychological profile of ten scavenger children from the Smoky Mountain in the Philippines was conducted in 1992. The results showed low levels of intellectual functioning of the scavengers of different age levels. It also demonstrated and inverse relationship between age and intelligence quotient. That is, the intellectual scores of children decreased as age increased. To a certain point, there can attributed to the  children’s preoccupation with survival and lack of learning opportunities. (Gust 1993:81) Aside from these risks, we cannot do away with the fact that poor working conditions of children often bring along infectious illnesses. Combined with malnutrition, toxic substance used at work affect several organ systems like the brains and nerves sometimes irreversibly. Some researchers make then point that the unhealthy sanitation, over crowding, poor ventilation, and extremes of temperatures in the work environment are aggravated by poor conditions in the living environment therefore, making working children more susceptible to new infectious illnesses and injuries, and other work-related ailments. Descriptive studies of hazardous and demonstrates the different types of risks: First, there is the â€Å" hazardous process†. Muro-ami fishing which practice in few fishing towns involves deep-sea diving without the use of protective equipment. This method was reported as a notoriously hazardous process resulting in drowning, deaths and rapture eardrums. Second, there is the exposure of children to adverse physical working environment. Exposure to organic dust is widespread in farms and plantations and tha prevalence of respiratory diseases is high. Children also work in repair shops, woodwork and in construction with constant exposure to dust and fumes. Third, children are exposed to dangerous substances in both formal and informal sectors. No personal protective equipment’s where given to the children who often handle chemicals with bare hands which was seen among those working in scavenging, in dumpsites, in gold processing, in leather industry, in garage, and in gasoline work. (Gust 1993: 80) No work is too difficult for these children despite the great risk on their lives. Nevertheless, this makes child labor a visible act of exploitation. E. How can we eliminate child labor in our Philippine society? The problem is huge, needless to say, the weapon in store must be equally extensive if not, stronger than the problem itself. All working children are basically at risk: the ultimate object of society should therefore be the elimination of child labor. However, the problem of child labor will not be solving overnight. It is â€Å"a large and complex problem† (ILO1994: 4). Some aspects of which are probably not yet capable of solution, for example, until a better knowledge and understanding can be gained, or until further progress has been made in addressing underlying social, cultural or economic factors. Given the multiple, over lapping causes at child labor, no single approach will and the scourge (Weissmen! 997:16). The resources available for combating child labor are glaringly in adequate when set against the magnitude of the problem. But no progress will be made at all unless start is made somewhere. Ideally, the Philippine government has already recognize the need to establish priorities and the Philippine plan of action for children has set targets for the protection and rehabilitation of abuse and exploited working children and for banning of children in hazardous occupations or situations, with priority being accorded to disadvantaged, depressed, and undeserved families and communities. The Government-UNICEF child labor Plan of Operation also establishes priorities for action. There emphasis action at the local level, without which no strategy to combat child labor will be effective. And with the formation of the â€Å"Sagip Batang Manggagawa†, and Inter-agency Quick Action Program (SBMQAP), the Philippine government has apparently taken the challenge in astounding force. The said program is established to respond to cases of child laborers in extremely object conditions and shall be responsible for the provision of various services in relation to the search and rescue operation. Elimination of child labor may justify seem impossible. Truly, our chances are slim, but there is hope. With these dynamic forces at hand, we can all look forward to a better and ideal future for the Filipino children. II. CONCLUSION: Child labor is an apparent hindrance to the economic, social, and moral development of the people and this country. This very uncharacteristic scenario in the workplace gradually yet tremendously cripples the country’s economy, destroys the ethical course of society, and deflates the standards of moral values. Nevertheless, â€Å"that trend is a human tragedy†(Senser 1997: 18). A manifestation of the world’s cruelty to the young and the innocent is what child labor is at its least. The children, being â€Å"the most vulnerable group in the society, who are unfortunate victims of this inhuman condition have been greatly deprived of the incalculable chances they ought to venture. Sad to say, our very own Philippine society has failed to provide the teeming Filipino children that exceptionally ideal community they all deserve. Yet, what soothes us the least is the fact that the child labor situation in our country has not been left in the rug and forgotten. After all, we dream of nothing less butter to hold strong in our pursuit of saving the Filipino children from falling into this bleak exigency. â€Å" Let not young souls be smothered out before. They do quaint deeds and fully flaunt their price. It is the world’s one crime its babes grow dull† (Linsay1997: 9) Bibliography :  ·Gust, E. 1993.
